      <description>&lt;p&gt;PUBLIC POLICIES AND THE DIFFICULTY TO IMPLEMENT SOCIAL RIGHTS IN BRAZIL&lt;/p&gt;&lt;p&gt;Abstract&lt;/p&gt;&lt;p&gt;With the enactment of the Constitution of 1988, the federal entities were given more autonomy and as a consequence, they started to be competent to plan and execute public policies, in order to accomplish social rights. However, the efficacy of these policies depends on the existence of resources, which makes the promotion of all the fundamental rights difficult. Therefore, the government should choose its investments priorities, assessing the budget capacity, since money is not sufficient to provide all the rights. In addition, society should play a more active role in the planning of public policies.&lt;/p&gt;</description>

      <description>This paper attempts to identify and characterize some of the heuristics that are present in the consumer decision-making in markets where information, regarding the quality or intrinsic risk associated with consumption of goods, is not perfect. In doing so we  integrate some tools coming from mainstream Law and Economics, socio-cognitive psychology and behavioral economics in order to evaluate the influence of these elements, taking mandatory warranties, as a preliminary case study.</description>

      <title>An Empirical Analysis of Cost Recovery in Superfund Cases</title>

      <description>&lt;p&gt;Economic theory developed in the prior literature indicates that under the joint and several liability imposed by the federal Superfund statute, the government should recover more of its costs of cleaning up contaminated sites than it would under non-joint liability, and the amount recovered should increase with the number of defendants and with the independence among defendants in trial outcomes.  We test these predictions empirically using data on outcomes in federal Superfund cases.  Theory also suggests that this increase in the amount recovered may discourage the sale and redevelopment of potentially contaminated sites (or “brownfields”).  We find  this increase to be substantial, which suggests that this implicit tax on sales may be an important deterrent for parties contemplating brownfields redevelopment.&lt;/p&gt;</description>

      <title>When Crime Pays: Measuring Judicial Efficacy against Corruption in Brazil</title>

      <description>&lt;p&gt;There is a widespread perception in Brazil that civil servants caught in corrupt practices are not punished. Yet, until now, there was no hard evidence that would support such claim and some argued that this was just a mislead perception due to the recent increase in anti-corruption measures. One of the main reasons for this notably absence is that it is very difficult to identify actual cases of corruption to, then, measure whether or not they are actually punished by the judicial system. This paper proposes a method of measuring judicial system efficacy against corruption by comparing proven corruption cases punished by administrative committees with criminal and civil judicial performance for the same cases. Ours results show that in fact the Brazilian judicial system is highly ineffective in fighting corruption.&lt;/p&gt;</description>

      <description>&lt;p&gt;Motor vehicle theft costs dearly to the Australian economy. Conservative estimates have put the annual cost of this form of illegal activity at 654 million during 1996. A number of initiatives aimed at reducing the incidence and cost of car theft have been implemented in recent years, yet statistics indicate that car theft is on the increase. Several authors have proposed an integrated approach to the regulation of markets for stolen property. Understanding property crime as a market is central to identifying approaches to its control. This paper discusses an industry model of crime and develops it on Australian data. Our model is an adaptation of one originally proposed by Vandeale (1978). It considers a production sector that uses inputs from a market of illegal labour to generate a supply of illegal goods that are traded in a product market.       <title>Forgiving Overconfidence in Tort Law</title>

      <description>&lt;p&gt;Overconfidence is an overestimation of one’s own ability that is often associated  with an underestimation of risks and inflated estimation of one’s future success. Debiasing overconfidence through tort law is not an easy task. If people tend to believe that risks are less likely to materialize for themselves than for others, they inadequately react to legal threats and incentives. For example, overconfidence may lead to the assumption of excessive risks, undermining the deterrent effect of liability rules, even if parties are provided accurate information about statistical facts. In this paper, we build an economic model to consider the role of tort rules in debiasing overconfidence. We show a surprising and counterintuitive implication: the most effective way to correct overconfidence in tort law may be to forgive it, rather than penalize it through liability.&lt;/p&gt;</description>

      <description>&lt;p&gt;This paper goal is to define a method to measure the index of restrictiveness of competition law focused on Latin America and the Caribbean and to determine if there are statistically significant causal relationships between competition law goals and the restrictiveness of CL. The index is defined based on the patterns and characters of statutory law and to determine what the incidence of the legal arrangement of competition law institutions in agent's perceptions of the institutional environment of competition is. Regarding causal relationships among competition law and competition intensity Results are not successful to determine a relationship of restrictiveness of competition law and subjective or objective measures of competition intensity.       <title>Environmental Protection for Developing Countries: The Polluter-Does-Not-Pay Principle</title>

      <description>&lt;p&gt;The polluter-pays principle stipulates that the person who damages the environment must bear the cost of such damage. A number of developing countries have recently extended this principle creating an obligation on the state to compensate the victims of environmental harm. This variation of the polluter-pays principle is aimed at ensuring victims’ compensation when polluters cannot be identified or are insolvent. These regimes hold state and local governments primarily or jointly-and-severally liable for environmental damage and allow the government to act in subrogation against the polluters. In this paper we study the effect of this form of governmental liability which we describe as the polluter-does-not-pay regime on the polluters’ incentives and on aggregate levels of environmental harm.       <title>Decentralization and Environmental Quality: An International Analysis of Water Pollution</title>

      <description>&lt;p&gt;The normative literature on decentralization of public goods provision has many testable empirical implications. This paper explores some of these implications by looking at the relationship between decentralization and an environmental public good, water quality in rivers at monitoring stations around the world. It examines pollution levels and interjurisdictional variation in these levels for both a local and a regional pollutant. The results suggest higher pollution levels with greater decentralization when fixed effects are included; the evidence is strongest for the regional pollutant, where it might result from interjurisdictional free riding. Federalism is associated with greater interjurisdictional variation in pollution within a country, consistent with the traditional view that decentralization allows policies more tailored to local conditions.&lt;/p&gt;</description>

Entrepreneurs face an unavoidable succession dilemma: they must make strategic decisions about transitioning ownership of the family business. The main alternatives are to sell the company to someone outside the family or to make arrangements for an interfamily succession. In the latter case, there are many transition modes, e.g., through a gift of shares, a will or a mixed marriage / succession contract. The choice of succession mode is the outcome of an interaction process between generations, with civil and tax laws determining the transactions costs of the different succession alternatives. On the basis of the economic literature concerning environmental law and economic development it is illustrated how criteria can be developed to examine whether specific environmental policy instruments can be used in the context of developing countries. Next these hypotheses are applied in a case study of Peru. The starting point for the analysis is the recently established Ministry of the Environment and its implications. The reform improved the health insurance coverage level, stating no limit to physician visits. The aim of this paper is to measure the effects – in particular on the utilization physician visits - of reform on private health insurance market. Three econometric methods were used: Poisson Regression, Negative Binomial Regression and Count Data Quantile Regression. Data come from the National Household Survey Sample (Pesquisa Nacional de Amostra de Domicilios-PNAD) for 1998 (before regulation) and 2003 (after regulation). The estimator of difference-in-difference is used to estimate the impact of regulation. The results showed that individuals with health insurance have greater number of physician visits, suggesting presence of moral hazard.&lt;/p&gt;</description>

      <description>&lt;p&gt;Preliminary measures adopted early in litigation are crucial for plaintiffs, given existing court delays and changing economic environment, but can also harm a blameless defendant. Therefore, some form of regulation is needed to minimize the harms that can result and discard non-optimal measures. Law and economic scholars have suggested that courts should control requests for preliminary measures, but this form of regulation fails to explain existing legislations, both in civil law and common law countries. This article argues that non-optimal preliminary measures can be more efficiently filtered through a strict liability regime, and that their judicial control should be residual.&lt;/p&gt;</description>

      <description>&lt;p&gt;In this paper we investigate the correct magnitude of pain and suffering damages for personal injuries. These damages differ greatly between and within countries, and the law of damages does not provide a framework to assess the correctness of the granted amounts. In our view, Law and Economics in combination with Health Economics is able to provide the required external framework.  In the Law and Economics literature, a tension exists between the prevention theory (stating that the injurer should fully compensate non-pecuniary losses) and the insurance theory (stat-ing that the victim should not receive compensation for non-pecuniary losses, because he would not self-insure against these losses). We discuss the scarce literature that suggests a synthesis between these two theories: by basing damages on the amount that victims would spend in order to reduce the expected non-pecuniary accident losses, the injurer receives the correct incentives and the victim is not over-compensated....</description>

Sunstein and Richard Thaler argue for a sort of soft paternalism referred to as “libertarian paternalism.” Relying on cognitive findings regarding the status quo bias, one of Sunstein and Thaler’s central claims is that default rules can be used for paternalistic purposes, given people’s proneness to adhere to what is established by these rules. This strategy is also called ‘libertarian’, since parties remain free to contract around the paternalistic rule if they wish. The main intuition behind our analysis is that the nations in which the rights of shareholders are more protected promote real and financial investment; this increases the speed at which the per capita income corresponding to the declining branch of the Environmental Kutznets Curve (EKC) is achieved. The mainstream has been the economic analysis of law, which considers the agent as a rational decision maker. The model was implemented using NetLogo 3.1.4, a multiagent software platform (Wilensky, 1999). The simulation program provides a wide range of dynamic options making it easy to perform any kind of test in order to assess the behavior of a given criminal rule in its dynamic operation.       <description>&lt;p&gt;This article addresses a European infringement proceeding against Spain, which was joined by other Member States in 2007, including Finland, the United Kingdom and Poland. The European Commission alleges a violation of the Second Company Law Directive through a discrimination of shareholders. It argues that Spanish companies are allowed to issue shares below the market value and exclude the pre-emption rights of the existing shareholders. Such share issues result in a wealth transfer from old to new shareholders (often referred to as a “dilution” of shareholdings), contrary to the equal treatment clause of the Second Directive. This article shows that the dispute is partly due to a misunderstanding of Spanish law, including legal culture.       <description>&lt;p&gt;Law and economics aids us in understanding why Roman law is still worthy of admiration and emulation. The admirable character of Roman law is its quality as an (almost) paradigmatic private law system. My discussion of Roman law illustrates how private law can align incentives for people to exert efforts to optimize investment and share information so as to reduce information asymmetries. Roman private law also enables people, who face resource constraints and incentive constraints, to act more consistently in their own interest and, when efficient, to act in the interest of others.       <title>Enforceability of Labor Law: Evidence from a  Labor Court in Mexico</title>

      <description>&lt;p&gt;We analyze lawsuits involving publicly-appointed lawyers in a labor court in Mexico to study the enforcement of a law that nominally provides high levels of worker protection. We show that, even after a judge rules in favor of the worker, the judgment goes uncollected 56% of the time due to the costs associated with the excessive formalism of the enforcement process. Diﬀerences in the probability of receiving compensation after trial, both across lawyers and across workers with dif-  ferent levels of tenure, are not due to diﬀerences in win rates at trial, but rather are entirely attributable to post-trial diﬀerences in the probability of enforcing the judgment. This paper is the ﬁrst in the literature that demonstrates the importance of post-trial collection costs on litigation outcomes. We then develop a simple model of litigation that includes costs of collecting awards after trial and show how diﬀerences in lawsuit outcomes across lawyers can be rationalized theoretically.&lt;/p&gt;</description>

      <description>&lt;p&gt;Legislatures have positive legitimacy to make law because of the power of the people who elected them. Throughout the world, however, unelected judges also make law. What, if anything, gives such judges positive legitimacy to make law? This paper demonstrates, through two superficially simple game theoretic models, that judges’ positive legitimacy is based on the power of people. Courts' legitimacy has the same basis as legislatures'. Since the French revolution, the ultimate arbiter in the social fight is the strongest faction, the majority. A group of people communicates its type to society at the ballot box. On the basis of the ballot count, society makes concessions to the terms dictated by the majority. Under what circumstances would an individual ever be able to dictate terms to society?       <description>&lt;p&gt;This paper has as main purpose to demonstrate that the economic analysis of law constitutes an objective, efficient and effective tool to the design and valuation of norms. Through the economic analysis of the proposed LP Gas Regulation, we intend to exemplify how a proposition that, in principle, is legally justified and aimed to achieve certain objectives, but economically can raise some issues. In the present analysis are used economic tools such as the identification of incentives for the recipients of the norm, game theory and cost-benefit analysis, in order to conclude that the proposed regulation, far from solving the existent problem with LP Gas, makes it larger and more complex, creating perverse incentives in the recipients of the norm.&lt;/p&gt;</description>

      <title>The social function of contract law in Brazilian Civil Code: distributive justice versus efficiency – lessons from the United States</title>

      <description>&lt;p&gt;The purpose of this paper is to describe the current status in Brazilian legal scholarship with regard to the interpretation of Section 421 of the new Civil Code that provides for respect of the social function of contracts. This is normally identified with the paternalist model of contract law and its idea of distributive justice, typical from the Welfare State legislation and policy. Second, the paper suggests a critical reading of this quasi consensus that is coming up among Brazilian jurists through an economic analysis of law and its emphasis on efficiency and the consequences of paternalism. The discussion in Brazil is contextualized with the debate of paternalism versus efficiency in contract law in the United States.&lt;/p&gt;</description>

      <title>Theoretical Approximation and Experimental Evaluation of Market Functioning when Transactions are Regulated by Adhesion Contracts</title>

      <description>&lt;p&gt;By using an economic model this paper describes and analyzes different forms of equilibrium within the market of the adhesion contracts where information is asymmetric and the agreement drafters decide which type of contract to offer considering that information is expensive for those who adhere. Under such conditions equilibriums are met in which contracts exist with the minimum possible quality associated to a price. In line with the economic analysis of law, the author concludes that the market is unable to correct inefficient agreements and this produces a limitation to the freedom of contract. This situation requires the implementation of controls over the contents of the adhesion contracts in order to ameliorate this result.       <description>&lt;p&gt;La aplicación efectiva de las leyes de competencia requiere de la participación activa de los particulares, especialmente en lo que se refiere a la reclamación de daños y perjuicios derivados del ejercicio de prácticas monopólicas. Esto es así, ya que la reparación del daño constituye una sanción impuesta al responsable y que constituye un desincentivo para cometer violaciones a la ley de la materia, a la vez que actúa como incentivo para  la denuncia de violaciones a la ley, así como para la colaboración de los afectados con la autoridad. Un sistema eficaz de reclamación de daños reforzaría las sanciones económicas y de otra naturaleza impuestas por la autoridad, para una promoción más efectiva del comportamiento anticompetitivo.
